#SaveLICH Update: The TRO Stands

Update:According to this Eagle story the Appellate Division, to which SUNY appealed Justice Baynes’ TRO, has issued a temporary order preserving the status quo as of Friday, July 19 at 4:00 p.m. This means SUNY may take no further steps to transfer patients or shut down services. The Eagle quotes Gibson Dunn litigation partner and Brooklyn Heights resident Jim Walden as saying a revised filing to be made today (Tuesday, July 23) will “make it clear that the Department of Health acted illegally” in approving SUNY’s closure plan.

As promised, Public Advocate Bill de Blasio went to court today, and Justice Johnny Lee Baynes confirmed that, contrary to SUNY Downstate’s contention and actions over the weekend, the Temporary Restraining Order Justice Baynes issued Friday barring SUNY from shutting down Long Island College Hospital is in effect despite SUNY’s notice of intent to appeal, because staying the TRO would cause irreparable damage to LICH. Justice Baynes has ordered a hearing on the issue for this Thursday, July 25.

The Public Advocate is represented in this matter by the prominent law firm Gibson Dunn & Crutcher, who also successfully represented the Brooklyn Heights Association and other plaintiffs in the Tobacco Warehouse litigation. The Public Advocate’s website asks that “i]f anyone has any information relating to failed patient care or staff harassment, please contact lead counsel Jim Walden at jwalden@gibsondunn.com.”

    SUNY spokesperson Robert Bellafiore told the Brooklyn Eagle late Monday, however, “Our motion to vacate the order was granted and was modified slightly. We do not have to bring ambulances back, restore residents or take any of the steps that were contained in the earlier lower court orders. Nor must we defer to the views of the LICH staff. All we need to do is keep services as they were late Friday afternoon and that means virtually no change from the way they are today.”

    I still don’t understand why Sen. Squadron et al. are unable to do anything tangible about this. SUNY is an organ of the state government, and so should be susceptible to the right kind of supervision/incentives from the state Senate. Marching, issuing press release, and getting arrested are nice but tangible action is better.

    I’m in the emergency room at LICH right now. My girlfriend is being treated for a kidney stone. Very painful for her but she is next to me on a ER bed, receiving wonderful care and everybody is so nice. This hospital NEEDS to stay open!

    I think Methodist should take over LICH and expand its services there instead of razing historical brownstones in Park Slope to double its size.

    Thanks, Susan and Remsen Street Dweller! She is much better now, home and resting comfortably. It was a rough few hours for her, but she told me she felt in good hands with the LICH staff. And they impressed me with their professionalism as well as their humanity.
    But sadly ambulances are still refusing to bring people to LICH. I confirmed this (while I had time waiting for her tests to come back) by asking inside the ER, and then outside LICH, asking several waiting ambulance drivers. I had been concerned that might be the case, so we got there by car service.
    But upon arriving there were LICH employes standing outside the building who helped us inside to the ER.
    The staff at LICH has my gratitude and admiration, and I want to do what I can to help this needed hospital survive, so I will be at the march tomorrow!

    I had the same thing happen with my wife. I took her by car service to the LICH ER. She also got quick and great care. A kidney stone is extremely painful for anyone who doesn’t know.

    Then he found out that he was wrong. Justice Baynes combined all the restraining orders into 1 that included restoring staff & service to the level in place at the time of the 1st restraining order on Feb 20, restrained the DOH, & referred the case to the DA for a criminal investigation. Individuals who have participated in killing LICH may be held in contempt & personally responsible
