As was earlier reported, the group Save The View Now claimed to have new evidence, in the form of building plans that show uses other than “mechanicals” for the rooftop structures on the Pierhouse and provisions in the governing land lease between the Brooklyn Bridge Park Corporation and the developers, Toll Brothers, that are said to clearly limit the heights of the Pierhouse structures. A hearing on STVN’s petition to re-open the case, which was earlier dismissed, was initially scheduled for July 30, but at the request of the defendants–BBPC, Toll Brothers, and others–was postponed until last Thursday, August 6. At that hearing, both sides presented oral argument (for a full description, see Mary Frost’s Eagle story). The judge, New York Supreme Court Justice Lawrence Knipel, announced at the closing that, while he had expected to be able to render a decision on the motion that day (no doubt meaning he had expected to be able to deny it), he would need time to consider the written submissions and oral argument before making a decision.
